Today in Michael Bay: One Lawsuit Dropped, Another Added Plus Some Kind Words From John Malkovich

michael_bay_explosion-225.jpgExplosion-extraordinaire Michael Bay is off the hook for the pistol-whip accusations, but the extra who was seriously injured during a stunt gone awry on the set of Transformers 3 is now suing, rightfully thinking she probably deserves more than the $25 she was paid for her work. Meanwhile, John Malkovich thinks the notoriously difficult director is a blast! Get the full story after the jump.

· Ever wonder how Bay gets the flames in those explosions just right or convinces the CGI designers to make his robots so detailed and intricate that you can't tell what the hell is going on or who is who? He doesn't settle. Bay and his legal team proved this once again in court. Not only did the two men who accused Bay's bodyguard of pistol-whipping them at Kiss Nightclub to completely drop their lawsuit, but he got the apology letter he said he would demand. Bay says no action will be taken against them besides some gloating on his blog. [TMZ

· Bay also got a pat on the back from John Malkovich, who plays Shia Lebeouf's boss in Transformers 3. Asked by MTV about Bay's reputation for being difficult and demanding, Malkovich said, "I found Michael delightful. I found him fun, filled with ideas..." With this in mind, I'd like to go on record as being totally down for a sequel to The Rock with Malkovich in the lead role. [MTV]

· In much sadder news, Gabriella Cedillo, a bank teller who was injured while doing extra work on the set of Transformers 3, is filing a negligence suit against the production. In the stunt, two towed vehicles were supposed to rise and then flip by use of a pulling cable, but the cable instead through Cedillo's windshield and part of her skull. Her legal team alleges that the welding on a bracket attached to a flatbed truck failed, and also that the same stunt had been attempted the day before unsuccessfully.

Cedillo is now paralyzed on her left side, but can write some and mouth words. The only (very slight) silver lining is that the studio probably has enough money to actually pay out if she wins, which isn't the case with all negligence suits. Still, it's already a tragic outcome no mater how you measure it. [Chicago Breaking News]

    Brian Clark, change the title and don't fool the people reding this so-called article. Bay has nothing to do with the extra suing the studio. His name is not involved or mentioned in any of the documents. He's the director sure, but it's not a trial against him. Let's keep that in mind.
    Btw, a person was killed, yes killed, on the set of The Dark Knight. Is Nolan in jail?
    I don't think so. So don't blow this story out of proportion. Her family will get the money outside of court, and it'll be over.
    Time to move on.

    Nolan wasn't found to be liable under those circumstances - noted.
    What does that have to do with this incident?
    The Director runs the show during shooting. He is in fact ultimately responsible when these things happen just like an architect is when building a house. Does that make it their "fault"? Maybe yes, maybe no. Maybe the guy doing the welding was on meth. I don't know anything about that and neither do you.
    If I follow your logic, since Nolan is walking around free, any director can make snuff films now? ? FAIL.
    Time to move on? She is paralyzed you dolt! Why don't you stop playing fanboi for 5 minutes & realize that a person's life has been changed forever so you can get a part 3 to a nostalgic toystore commercial for adults...

    I'm glad that Gabriella Cedillo lived. I've been wondering how she's been faring. Shame she has to SUE them to get the money, when they should just PAY her right off the bat for what happened. Humanity sucks.
